Terms of Use
FORCE CM, LLC
Effective Date: September 23, 2026
These Terms of Use ("Terms") govern your access to and use of the FORCE CM website at www.forcecm.org, along with the programs, online materials, registration and reservation processes, and other services made available through it. The website and services are operated by FORCE CM, LLC ("FORCE CM," "we," "us," or "our"), a New York limited liability company with operations in New York and New Jersey.
By accessing or using the website, submitting a form, registering for a program, reserving an engagement, or purchasing services through the website, you agree to these Terms. If you do not agree, please do not use the website or purchase services through it.
1. About FORCE CM
FORCE CM provides leadership development, problem solving, finance operations advisory, leadership transition support, private advisory, and related professional services. Our offerings may include the Leadership Advancement Program, Problem Solving Lab, Private Finance Advisory, Finance Operations Advisory, Finance Leadership Transition Week, and other programs, events, advisory services, and resources we introduce from time to time. Specific offerings, availability, formats, pricing, eligibility, and terms may change.
2. Eligibility
The website and our services are intended for adult professionals and organizations. You must be at least 18 years old to register for a program, reserve an engagement, or purchase services. If you act on behalf of an organization, you represent that you are authorized to bind that organization to these Terms.
3. Website Information
We make reasonable efforts to keep website information accurate and current. However, program dates, availability, facilitators, pricing, formats, schedules, content, and other details may change. We may correct errors, update information, modify offerings, or discontinue programs or services at any time. Information on the website does not guarantee that a particular program, facilitator, date, engagement, or service will remain available.
4. Programs and Advisory Services
Some FORCE CM offerings are cohort-based, some are private, and others are customized for an organization or individual. Participation may be subject to additional terms provided through a registration or checkout page, proposal, engagement letter or agreement, program participation agreement, reservation confirmation, or other written terms specific to the service.
If service-specific written terms conflict with these Terms, the service-specific terms control for that service. A signed engagement agreement controls over these Terms for any matter it specifically addresses.
5. Reservations and Fit
Some services allow you to reserve availability before the full scope of an engagement is finalized. A reservation does not by itself mean that FORCE CM has accepted an engagement. For certain services, the reservation process may include an introductory meeting or other fit assessment before the engagement is confirmed.
We may decline an engagement when we believe the requested work falls outside our scope, expertise, capacity, or professional obligations, or when we cannot serve the client appropriately. Any reservation period, hold period, deposit requirement, refund provision, or next step will be disclosed with the applicable offer.
6. Payments and Deposits
Prices and payment terms are provided on the applicable program page, checkout page, proposal, invoice, or engagement agreement. Unless otherwise stated, all payments are in U.S. dollars. We use third-party payment processors, such as Stripe, to process payments.
When a reservation deposit is required, the applicable offer will explain:
-
The deposit amount
-
Whether and when it is refundable
-
Whether it will be credited toward the full engagement or program fee
-
Any deadline for completing the next step
-
Any cancellation or rescheduling conditions
Those terms form part of your purchase. Not every payment is nonrefundable; refund eligibility depends on the terms of the specific program, reservation, or engagement.
7. Cancellations, Refunds, and Rescheduling
Cancellation, refund, transfer, and rescheduling terms may differ by program or engagement and will be provided before or at the time you make a payment or confirm an engagement. Where we state that a deposit or payment is refundable under certain conditions, we will honor those conditions.
Where rescheduling is permitted, availability may depend on future cohort dates, facilitator capacity, or advisory availability. We may reschedule a program or session when necessary due to illness, facilitator unavailability, technical failures, or other circumstances beyond our reasonable control. If we cancel a paid program or engagement and cannot offer a reasonable alternative, we will provide a refund or credit according to the applicable program or engagement terms.
8. No Recurring Charges Unless Disclosed
We will not enroll you in a recurring paid subscription because you purchase a program, pay a deposit, or participate in an advisory engagement. If we offer a recurring membership, subscription, or automatically renewing service in the future, we will clearly disclose the recurring nature of the charge, its frequency, price, and cancellation terms, and obtain your consent before you enroll.
9. Professional Services and Credentials
FORCE CM works with professionals experienced in finance, accounting, human resources, operations, leadership, and related fields. Our team may include licensed CPAs, SHRM-SCP credential holders, current and former finance executives, operations specialists, and other experienced practitioners.
The presence of a particular credential on our team does not mean that every FORCE CM service is a regulated professional service. Unless expressly agreed in a written engagement agreement, FORCE CM does not provide:
-
Legal advice or representation
-
Audit, review, or other attest services
-
Tax return preparation or tax advice
-
Investment advice or securities advice
-
Any other service requiring a professional license or engagement not expressly agreed to
If a situation requires expertise outside the agreed scope, we may recommend that you consult an appropriately licensed professional.
10. Educational Content Is Not Individualized Advice
Articles, videos, social media posts, downloads, presentations, newsletters, workshops, website content, and other general FORCE CM materials are provided for educational and informational purposes. They are not individualized accounting, tax, legal, investment, employment, human resources, or other professional advice, and your organization and circumstances may differ from the examples discussed. An advisory relationship is created only when FORCE CM and a client enter into an engagement through the process established for that service.
11. No Guarantee of Results
Our services are designed to support leadership development, problem solving, organizational improvement, and stronger finance operations. Results depend on many factors outside our control, including the participant, organization, leadership team, employees, systems, decisions, implementation, timing, and circumstances.
We do not guarantee any specific outcome, including a promotion or new role, increased compensation, employment or continued employment, a particular hiring result, increased revenue or cost savings, resolution of a specific problem, or any other organizational, financial, or business result. Examples of prior participant or client outcomes are illustrative and do not guarantee future results.
12. Participant Conduct
Participants are expected to engage professionally, respect other participants, follow facilitator instructions, and avoid behavior that disrupts others' experience. We may remove a participant from a program for serious or repeated disruptive, abusive, threatening, discriminatory, unlawful, or otherwise inappropriate conduct. Any refund in that situation will be determined under the applicable program terms and circumstances.
13. Confidentiality in Group Programs
Cohorts, Labs, and other group programs may involve discussion of real professional situations. Participants must respect the confidentiality of information shared by others. You may discuss your own experience with a FORCE CM program, but you may not disclose confidential, proprietary, identifying, or sensitive information shared by another participant or organization without authorization. We may set additional confidentiality expectations for a particular program.
Because group programs involve independent participants, FORCE CM cannot guarantee that every participant will comply with these expectations. Please use good judgment when deciding what to share.
14. Recording
You may not record, photograph, stream, transcribe, or otherwise capture FORCE CM program sessions, advisory meetings, presentations, or materials without our prior authorization. This includes the use of AI note-taking, transcription, or meeting-assistant tools.
We may record certain sessions when appropriate. If a participant-facing session will be recorded, we will inform participants in advance.
15. Intellectual Property
The website and all FORCE CM materials are owned by or licensed to FORCE CM and are protected by intellectual property laws. This includes program materials, frameworks, methods, exercises, worksheets, templates, presentations, videos, training materials, written content, graphics, designs, website copy, brand names, and logos.
Participating in a program does not transfer ownership of any FORCE CM intellectual property to you. You may use materials provided to you for your own internal professional or organizational purposes, subject to any additional restrictions provided with those materials. Without our written permission, you may not reproduce, publish, sell, license, distribute, teach, commercially adapt, or otherwise commercially exploit FORCE CM materials, or use them to create a competing program.
16. Acceptable Use of the Website
You may use the website only for lawful purposes. You may not:
-
Interfere with the operation or security of the website
-
Attempt unauthorized access to our systems or information
-
Introduce malicious software
-
Use automated tools to extract substantial website content without permission, including for training AI models
-
Impersonate another person
-
Use the website to commit fraud or other unlawful activity
-
Use FORCE CM intellectual property without authorization
We may restrict access when reasonably necessary to protect our website, systems, company, clients, participants, or intellectual property.
17. Information You Submit
When you submit information through the website, you represent that you have the right to provide it and that it is accurate to the best of your knowledge. Do not submit another person's confidential, sensitive, or proprietary information unless you are authorized to do so. Personal information submitted through the website is handled according to our Privacy Notice.
18. Feedback
If you voluntarily share suggestions or feedback about FORCE CM, our website, or our services, we may use it to improve our business, programs, and services without obligation to you. Providing feedback does not give FORCE CM ownership of your confidential organizational information, and it does not give us permission to publicly identify you or your organization.
19. Testimonials, Names, and Likeness
Participating in a program or engagement does not give FORCE CM permission to publicly use your name, photograph, employer, logo, testimonial, or other identifying information. We will obtain your permission before doing so.
20. Third-Party Services
The website may link to or integrate with third-party services for payments, scheduling, email, video conferencing, forms, social media, recruiting, analytics, and other functions. We do not control these services, and your use of them may be governed by the provider's own terms and privacy notice. A link to a third-party website is not an endorsement of that provider's content, products, or services.
21. Website Availability
We do not guarantee uninterrupted or error-free access to the website. It may occasionally be unavailable because of maintenance, technical problems, service-provider disruptions, security issues, upgrades, or circumstances outside our reasonable control. We may change or discontinue any part of the website at any time.
22. Disclaimer of Warranties
THE WEBSITE AND GENERAL WEBSITE CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE EXTENT PERMITTED BY APPLICABLE LAW, FORCE CM DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, RELATING TO THE WEBSITE, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
Warranties relating to paid programs and engagements, if any, are governed by the applicable program or engagement terms.
23. Limitation of Liability
TO THE EXTENT PERMITTED BY APPLICABLE LAW, FORCE CM, LLC AND ITS OWNERS, EMPLOYEES, CONTRACTORS, FACILITATORS, CONSULTANTS, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES ARISING FROM OR RELATED TO YOUR USE OF THE WEBSITE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM YOUR USE OF THE WEBSITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100).
Liability for paid programs and professional services is governed by the limitations in the applicable program or engagement agreement.
24. Indemnification
To the extent permitted by applicable law, you agree to indemnify and hold FORCE CM harmless from third-party claims, damages, liabilities, and reasonable costs, including reasonable attorneys' fees, arising from your unlawful use of the website, your violation of these Terms, or your infringement of another person's rights. You are not required to indemnify FORCE CM for claims arising from FORCE CM's own negligence or misconduct.
25. Governing Law and Venue
These Terms are governed by the laws of the State of New Jersey, without regard to conflict-of-law principles. Unless a separate written agreement provides otherwise, any legal proceeding arising from these Terms or your use of the website must be brought in a state or federal court located in New Jersey.
Separate client, program, employment, contractor, or engagement agreements may contain their own dispute-resolution provisions, which govern those relationships.
26. Changes to These Terms
We may update these Terms as our website, services, programs, technology, or legal obligations change. The current version will be posted on the website with an updated effective date. Changes apply prospectively, and your continued use of the website after updated Terms take effect constitutes acceptance of them for future use. Updated Terms will not override contrary terms in an existing signed agreement.
27. Electronic Communications
When you submit forms, make reservations or payments, accept terms electronically, or otherwise communicate with us electronically, you consent to conducting those interactions electronically. Electronic confirmations, agreements, notices, and records satisfy any legal requirement that such communications be in writing, to the extent permitted by law.
28. General Provisions
Severability. If any provision of these Terms is found unlawful or unenforceable, it will be limited to the minimum extent necessary, and the remaining provisions will remain in effect.
No waiver. Our failure to enforce any provision of these Terms is not a waiver of our right to enforce it later.
Entire agreement for website use. These Terms and our Privacy Notice are the entire agreement governing your use of the website. They do not replace program agreements, engagement letters, proposals, employment or contractor agreements, or other written agreements entered into separately with FORCE CM.
